Legislative Process

The DPR has the power to make laws. The DPR and the President jointly-discuss and approve every Bill. Bills may come from the DPR, the President or the DPD.

The DPD may propose a Bill to the DPR which is related to regional autonomy, relationships between the Central and Regional Governments, formation, expansion and consolidation . of regions, management of natural resources and other economic resource as well as those related to financial balances between the Central Government and Regional Governments. In the event that there are 2 (two) Bills being proposed on the same matter in one Session Period deliberation is made on the DPR Bill, while the Bill proposed by the President serves as the accompanying material.

 

In the context of the drafting of a Bill, the public is entitled to provide inputs verbally and in writing by mentioning their clear identity to the DPR forwarded to the Leadership of the DPR and is subsequently passed on to the DPR Complementary Organ drafting the Bill by no later seven days.

 

The Complementary Organ determines the time for meeting and the number of persons invited in the relevant meeting. The result of the meeting is used as food for thought for the drafting of the Bill concerned.

The discussion of bills at the House of Representatives of the Republic of Indonesia (DPR RI) is conducted through two deliberation levels, namely: Level I in the Commission Meeting, Legislation Council Meeting, Budget Committee Meeting or Ad-hoc Commission Meeting together with the Government; and Level II in the Plenary Meeting.

 

Before conducting Level I and Level II deliberations, each faction holds a Faction Meeting. Bills that have been approved by the DPR are forwarded to the President by the Leadership of the DPR to be ratified as laws. Bills that have been jointly approved by the DPR and the President are submitted to the President by the Leadership of the DPR to be ratified as laws by no later than 7 (seven) working days. In the event that following the 15 (fifteen)-working day period, the bills that have been submitted to the President have yet to be ratified as law, the Leadership of the DPR sends a letter to the President to ask for clarifications. In the event that the Bills that have been jointly approved are not ratified by the President within a period of 30 (thirty) days as from the joint approval of the Bills, the relevant Bills becomes laws and must be promulgated.

 

Law-Making Process Initiated by the President

A Bill together with its elucidation/remarks, and or academic papers originating from the President are submitted in writing to the Leadership of the DPR with a Cover Letter from the President mentioning the Minister representing the President in discussing the Bill concerned.

 

Following the receipt of the Bill by the Leadership of the DPR, the Leadership of the DPR subsequently notifies the Members of the receipt of the relevant Bill in the subsequent Plenary Meeting and then distributes the copies thereof to al1 Members. The Bill related to DPD is submitted to the Leadership of the DPD.

 

The Bill is disseminated by the initiating agency. The Bill then is discussed at two deliberation levels at the DPR together with the minister representing President.

 

Law-Making Process Initiated by the DPR RI

At least 13(thirteen) DPR members may initiated a Bill. A bill may also be proposed by a Commission, Joint Commission or the Legislation Council.

The initiated Bill together with the remarks of the proponents are submitted in writing By the Members, the leadership of a Commission, the leadership of a Joint Commission Or the legislation Council to the leadership of the DPR along with the list of names and Signatures of the proponents as well as the names of their factions following the harmonization, rounding and consolidation of conceptions of the initiated bill.

 

Following the receipt of the bill by the Leadership of the DPR, the meeting chairperson Notifies the members of the receipt of the proposed bill in the subsequent Plenary Meeting and the copies thereof are distributed to all Members.

 

The plenary Meeting decides whether the proposed bill may basically be accepted as DPR Bill or not. Decision is made after giving the opportunity to each faction to put forward their opinions. The decision can be in the form of :

 

  1. approval without amendment;
  2. approval with amendment; or
  3. rejection.

 

If the Bill is approved with amendment, the DPR assigns a Commission, the Legislation Council or Ad-hoc Committee to revise the relevant bill.

 

Following the approval as DPR Bill, the Leadership of the DPR submits it to the President with a request that the President appoint a Minister who will represent the Government in the discussing the bill together with the DPR and to the Leadership of the DPD if the Bill is related to the DPD.
